Acceptable Use Policy

This Acceptable Use Policy sets out the rules for the messages you draft, export, or send through SimpleSend (the “Service”), and for the mailboxes and domains provisioned through it. It forms part of our Terms & Conditions, and terms defined there have the same meaning here. How we handle the data involved is described in our Privacy Policy.
1. Scope
This policy applies to every message you draft, export, or send through the Service, whether it goes out through your own tools or from mailboxes provisioned through the Service, and to every mailbox and domain provisioned for you. It applies equally to your team members and to any AI assistant or integration acting with your account’s keys.
2. Who you may contact
Contact only business recipients for whom you have a lawful basis, such as a legitimate interest in business-to-business outreach or the recipient’s consent, and be ready to show what that basis is.
- Do not upload or enroll purchased or scraped lists whose provenance you cannot document.
- Do not upload sensitive personal data (such as health, financial-account, or government-ID information) or data about anyone under 18.
- Respect every do-not-contact request, whichever channel it arrives through: a reply, a LinkedIn message, a phone call, or a note sent to us.
3. What every message must contain
Every commercial message sent through the Service must:
- identify you accurately as the sender, with a reply address you monitor;
- carry a working way to opt out. The Service adds an opt-out line and an unsubscribe link under the signature of every step; you may reword the line, but you may not remove or hide either;
- include your valid postal address. The Service prints the business mailing address from your sending settings under every signature; keep it current;
- have a subject line that matches the content;
- use no forged or misleading headers, and never impersonate another person or organization.
4. Opt-outs and suppression
Honor every opt-out promptly. The Service suppresses the opt-out replies it recognizes automatically; anything it does not recognize, including requests that reach you through other channels, you must add to your suppression list within 10 business days.
Never re-add a suppressed address, whether by re-importing a list, editing the address, or enrolling it in a different sequence. Suppression applies across your whole team: an address one teammate suppresses is suppressed for everyone in your workspace.
5. Volume, warmup and pacing
Mailboxes provisioned through the Service warm up before they send cold email, and every mailbox has a daily sending cap. Respect both. Do not try to get around pacing, for example by rotating mailboxes, splitting one campaign across accounts, or sending the same list from outside the Service at the same time.
Provisioned mailboxes are for your own outreach and its replies only. Do not share, rent, or resell them, and do not use them for anything else, such as transactional email, mailing lists, or personal mail.
6. Tracking
Open and click tracking is on for a new sequence and can be turned off in its settings. Where you use it, you are responsible for any notice or consent your recipients’ jurisdictions require, including the ePrivacy Directive in the EU and PECR in the UK. Do not track recipients who have opted out.
7. Prohibited content
Do not use the Service to draft, export, or send content that:
- is unlawful, deceptive, fraudulent, defamatory, or harassing;
- is phishing, or seeks credentials, payment details, or other sensitive information under false pretenses;
- carries malware or links to it;
- infringes anyone’s intellectual property, privacy, or other rights;
- promotes goods or services where doing so is unlawful in the recipient’s jurisdiction (for example, controlled substances, weapons, or unlicensed financial products).
8. Our enforcement
We watch bounce and complaint rates. We may lower your sending caps, pause a sequence or a mailbox when bounces or complaints cross the thresholds shown in the Service, suspend sending on your account, or terminate your account for a breach of this policy. Where we can, we tell you what happened and how to put it right.
The rules of the platforms that host and provision your mailboxes, including Google, Microsoft, and our infrastructure provider, InboxKit, also apply. If they suspend or remove a mailbox or domain, that suspension or removal is passed through to you, and we may be unable to reverse it.
9. Reporting
If you received a message sent through the Service that you believe breaks this policy, or have any other concern about abuse, write to us at ethan@simplesend.tech. Include the message headers where you can. We investigate every report and act on it, which can include suppressing your address across the sender’s team and suspending the sender.
10. Changes
We may update this policy from time to time. We will post the new version on this page and revise the “Last updated” date at the top. By continuing to use the Service after an update is posted, you accept the revised policy.
